The Vengeance App (the "Platform") is owned and operated by Youthful Vengeance Inc., or its successors and assigns (collectively, "Youthful Vengeance," "we," "us," or "our").
These Terms of Service ("Terms") govern access to and use of the Platform, including all related websites, applications, and services.
By accessing or using the Platform, you agree to be bound by these Terms and by our Privacy Policy, incorporated herein by reference.
If you do not agree, you may not use the Platform.
Use of the Platform is limited to individuals who are at least 18 years of age or have the consent of a parent or legal guardian.
Users must create an account to access certain features. Account types include Artist, Organization, Curator, and Admin. Users must provide accurate, current, and complete information.
Youthful Vengeance may require email verification or other identification measures.
Users are responsible for maintaining the confidentiality of login credentials and for all activities conducted under their account.
Youthful Vengeance may suspend or terminate accounts that violate these Terms or applicable law.
The Platform enables artists, curators, and organizations to create profiles, list and apply to programs, upload and review creative work, and facilitate transactions related to arts and cultural programming.
Youthful Vengeance acts solely as a neutral intermediary, providing a digital infrastructure for interaction between users. Youthful Vengeance is not a party to any agreements, transactions, or arrangements entered into between users.
Youthful Vengeance is not responsible for any transactions or communications conducted outside the Platform, even if initiated through it.
The Platform facilitates payments through third-party services such as Stripe. Youthful Vengeance does not process or store payment card data directly and is not responsible for payment processor decisions, including chargebacks or transaction reversals.
Artists and organizations may be charged application, participation, or service fees. Fees are disclosed prior to transaction completion and are non-refundable unless expressly stated otherwise.
Users are responsible for any applicable taxes arising from their use of the Platform or related transactions.
Artists retain ownership of all artwork, text, images, and other materials they upload ("User Content").
By uploading User Content, users grant Youthful Vengeance a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content for Platform operation, reporting, and promotional purposes.
Users represent that they own or have permission to use and upload their content and that such content does not infringe any third-party rights.
Pornographic, defamatory, or illegal content is prohibited. Youthful Vengeance reserves the right to remove or disable access to content at its discretion.
Content and related data may be securely shared with partner organizations such as the Vengeance Foundation solely for program administration or reporting purposes.
Youthful Vengeance may maintain automated backups or archives of uploaded content but does not guarantee permanent storage.
6.1 Curators and organizations may evaluate artist submissions using rating and comment tools.
6.2 Artists acknowledge that evaluations and feedback are confidential and may not be visible to them.
6.3 Youthful Vengeance may monitor communications and submissions for compliance and moderation purposes.
6.4 Users are expected to engage respectfully and professionally; harassment or inappropriate conduct may result in suspension.
Use of the Platform is subject to the Vengeance App Privacy Policy, which explains how we collect, store, and process personal data.
Users consent to the transfer and storage of data in the United States through secure third-party hosting providers.
Youthful Vengeance will not sell or disclose personal information except as described in the Privacy Policy or as required by law.

Youthful Vengeance reserves the right to suspend or terminate access for violations of this section.
The Platform may include digital agreements, acknowledgments, or e-signature forms (e.g., gallery usage agreements or eligibility confirmations).
By submitting these forms, users acknowledge that such submissions constitute legally binding electronic consent under applicable law.
The Platform and its services are provided "as is" and "as available".
Youthful Vengeance makes no representations or warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant uninterrupted or error-free operation or that data will be secure or permanently stored.
From time to time, maintenance or technical issues may temporarily limit access to the Platform.
To the maximum extent permitted by law, Youthful Vengeance's total liability for any claims arising from or related to the Platform shall not exceed the greater of one hundred Canadian dollars (CAD $100) or the total amount paid by the user to Youthful Vengeance during the twelve (12) months preceding the claim.
Youthful Vengeance shall not be liable for indirect, consequential, or incidental damages, including loss of profits, data, or goodwill, even if advised of such damages.
Users agree to indemnify, defend, and hold harmless Youthful Vengeance, its affiliates, officers, directors, and employees from and against all claims, damages, and expenses arising from (a) user content, (b) misuse of the Platform, or (c) violation of these Terms or applicable law.
Any feedback, suggestions, or ideas submitted to Youthful Vengeance regarding the Platform shall be deemed non-confidential and royalty-free. Youthful Vengeance may use or implement such feedback without obligation or compensation.
The Platform may include integrations or links to third-party services (e.g., Stripe, Google, or social media). Youthful Vengeance is not responsible for the content, security, or policies of those services. Users access them at their own risk.
Youthful Vengeance may, at its discretion, suspend or terminate access to the Platform for any user who violates these Terms, engages in fraudulent activity, or poses a risk to other users.
Termination does not relieve users of obligations accrued before termination, including payment obligations or liability for uploaded content.
Upon termination, Youthful Vengeance may delete user data and content consistent with its Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles.
All disputes shall be submitted to the exclusive jurisdiction of the courts located in Toronto, Ontario.
Youthful Vengeance may modify these Terms at any time by posting the updated version on the Platform. Continued use after such posting constitutes acceptance of the revised Terms.
